Abstract

 The Criminal Code (KUHP) or Wetboek va Strafrecht (WvS) is a legaly legal product from Dutch colonial rule, which was enacted in 1946 under Lawa Number 1 of 1946 as the KUHP and officially adopted into Indoensia law. After being used 77 years as the national criminal law reference, the new KUHP was officially enacted through Law Number 1 of 2023, marking a new histerical milestone in judicial system of Indonesia. After Indonesia declared independence on August 17 th 1945, the country continued using Ducth’s legal product in its criminal justice system, namely the Criminal Code (KUHP). Judges based their legal decisions on this Ducth era KUHP, which, although modified for Indonesian use, had already been reformed and abadoned in the Netherlands.

 

A historic moment has been achieved by Indoensia with the enactment af Law Number: 1 of 2023 concerning the KUHP, signed and promulgated on January 2, 2023, in stete Gazette of the Republic of Indonesia year 2023 Number 1. According to Article 624 of the new KUHP, it is stade: “This Law shall come inte force three (3) years after the date of publication” Thus, the National KUHP ill effectively aplly starting January 2ndm 2026. The new KUHP also implements the Universal Prinsiple applicable in international law, reflecting Indonesia’s identity as a member of the global community. Its implementation remains bound to international agreements and must accommodate international issues relevant to modern society
